Prosecution framed the MEV activities as fraudulent, potentially guiding future regulatory frameworks and technological defenses against similar activities. “There is no separate law about fraud on the blockchain … you can’t tell a lie and deceive people to get their money, whether on the phone, online, or on Ethereum,” said Assistant US Attorney Danielle Marie Kudla, U.S. Department of Justice.
